Subject: Leaflets at Shell Centre

My colleague, Mr Brandjes, tells me that you intend to distribute leaflets outside Shell Centre.

It would be helpful if you could let us know when you intend to do this so we can alert our security people to expect you or your helpers. As usual, they will not of course interfere with your lawful activities, but you will appreciate that, like most other large organisations in major cities, we at a higher than usual state of alert and  some forewarning would help to make their lives easier.

Many thanks,
Richard Wiseman

Reponse by email from John Donovan, 31 July 2007 (Copied to Michiel Brandjes, Jeroen van der Veer, Jorma Ollila, Malcolm Brinded and Bill Campbell)

Dear Mr Wiseman

The first point to make is that there was no slight intended by dropping you from the usual circulation list. I wrongly thought that because you are now General Counsel responsible for Merger & Acquisitions and Project Finance, that you would be extremely busy on matters relating to BP for example, and that our activities would no longer be of any interest you. It is evident from your intervention within hours of being omitted from the list that this was a mistake.

Please be assured that we will, as per normal, give you advance notice of our leafleting plans. The leaflet is being prepared. Would you like to have advance sight of it before it is circulated? The content relates mainly to Bill Campbell and Shell’s infamous “Touch F*** All” safety policy. We will be of course include reference to the Accountability in Action newsletter headed: “Accountability in Practice: Royaldutchshellplc.com The power of a website.” We will include some extracts such as their comment that we provide a “valuable watchdog function” (over Shell) and the “profound impact” we have had on Shell (including costing Shell billions). Naturally we are delighted with the comments coming, as they do, from an independent prestigious source: the One World Trust.

The apologies given by Mr Brandjes in his email this morning are accepted, although I am still unclear whether he is passing on to the Company Secretarial the matters I have raised in regard to the Data Protection Act, including the fact that Shell has not acted in accordance with its legal obligations.

In this connection, you may recall accidentally sending us a copy of your internal email to Jeroen van der Veer and Malcolm Brinded about my father and his allegations/comments relating to Mark Moody-Stuart.  We can appreciate that this was an enormously sensitive and embarrassing blunder of the kind we can all make, but that important communication, which we know for certain exists, was not supplied to us under the DPA  application as it most certainly should have been.

This omission naturally makes us wonder what other sensitive and embarrassing documents were also withheld. Your accidental leak of the email revealed that contrary to your assertion that Shell was disinterested and unmoved by our activities, the reverse is the case. Your email also revealed that your media department has an action plan ready to respond immediately we write to any third party. Yet strangely the only example of the standard letter was the one you supplied to us at the time. You made it clear that the content varied according to circumstance, yet none of these “PX” letters have been supplied to us?

Leaving the DPA subject to one side, it was nice to hear from you again. It is unusual for you to instigate correspondence with us. The last occasion, if I recall correctly, was when you very kindly supplied an up to date photograph of yourself for display on our website. That also tended to undermine your claim of disinterest in our activities, as indeed does your email today.  Nonetheless, we are grateful for your continued fascination with our plans.

Yours sincerely
John Donovan

Response from Michiel Brandjes, 31 July 2007: 11.30am

Dear Mr. Donovan,

Mr Wiseman will respond to you on the issue of the intended distribution of leaflets near Shell offices.

I have forwarded your comments and queries on the request pursuant to the Data Protection Act to the company secretariat of Shell International Ltd in London. I trust that they will respond if and as appropriate in due course. I suggest that you communicate with them directly by mail rather than via me with the company secretariat of Royal Dutch Shell Plc in The Hague.
