Oil Companies Rejected by Supreme Court on Moving Climate Fight

The U.S. Supreme Court rejected an appeal by oil companies including BP Plc and Exxon Mobil Corp., leaving intact an important procedural ruling favoring two California cities suing for billions of dollars to address the impact of climate change.

The justices, without comment, refused to consider the industry’s bid to shift the lawsuit into federal court, where companies tend to fare better than they do before state tribunals. read more

In the fight against climate change, one tool is proving increasingly popular: litigation. From the U.S. to Europe and India, activists, governments and concerned citizens have turned to the courts. Supporters want them to force oil companies and governments to pay for past harms and avert future threats.

Are international companies vulnerable?

Yes. In May Royal Dutch Shell Plc was ordered by a Dutch court to slash its emissions harder and faster than planned, a ruling that could have far-reaching consequences for the rest of the global fossil fuel industry. Shell, which said it expects to appeal the ruling, has pledged to reduce its greenhouse gas emissions by 20% within a decade, and to net-zero before 2050. That’s not enough, according to the court in The Hague, which ordered the oil producer to slash emissions 45% by 2030 compared with 2019 levels. The court said the ruling applies to the entire Shell group, raising the prospect of the company having to radically speed up its current climate and divestment policies in order to hit the new target. It’s unlikely Shell will be the only company to fall foul of the courts as the Dutch decision will likely trigger similar cases around Europe, if not the world. read more

(Bloomberg) — Royal Dutch Shell Plc’s head expects clean energy to make up half of the company’s energy mix “somewhere in the next decade.”

“If we do not make that type of process by the middle of next decade, we have a problem not just as a company but as a society,” Chief Executive Officer Ben van Beurden said in an interview with AXIOS on HBO.

Like its European peers, the Anglo-Dutch major has set itself an “ambition” to become a net-zero emissions energy company by the middle of this century. The feat involves producing less oil, more gas and renewables, as well as using technologies still in their infancy like hydrogen and carbon sequestration. Not everyone is convinced, with the energy giant set to clash with some shareholders on the matter at its annual general meeting later this month. read more

Shell has asked for permission to leave the columns — each almost as tall as the Eiffel Tower and together weighing around 1 million tons — jutting from the water because it says removing them would pose a greater environmental risk. (Bloomberg) — Royal Dutch Shell Plc appointed former BHP Group executive Andrew Mackenzie as chairman, and said its board would have as many women as men on it for the first time.

Mackenzie, who oversaw BHP’s retreat from shale, takes over from Chad Holliday, whose departure had been flagged since last year. It also appointed cyber expert Jane Lute, a move that will take its board to gender parity, the company said.

“Andrew brings to Shell his experience of leadership, his global outlook, and a deep understanding of the energy business and climate action,” the company said in the statement. read more

 Nigerian court rejected Royal Dutch Shell Plc’s bid to overturn an order restricting access to the company’s bank accounts in the West African country, a spokesman said.

Aiteo Eastern E&P Co. obtained an injunction from a federal court in Lagos on Jan. 25 directing Shell and multiple Nigerian banks not to let the oil major withdraw funds “without first preserving or ring-fencing” almost $2.8 billion. A judge refused Shell’s application to vacate the order at a hearing on Tuesday, according to a spokesman for the company’s Nigerian unit. read more

Nord Stream 2, as it’s called, fuels worries in the U.S. and other countries that the link could give the Kremlin new leverage over Germany and other NATO allies. Pipe construction, halted in 2019, resumed in December 2020, yet U.S. sanctions still threaten to pull the brakes on the project backed by the Russia’s Gazprom PJSC.

1. What is Nord Stream 2?

It’s a 1,230-kilometer (764-mile) gas pipeline that will double the capacity of the existing undersea route from Russian fields to Europe — the original Nord Stream — which opened in 2011. Gazprom owns the project operator, with Royal Dutch Shell Plc and four other investors contributing half of the 9.5 billion-euro ($11.6 billion) cost. Initially expected to come online by the end of 2019, the link has been delayed by U.S. sanctions that forced Swiss contractor Allseas Group SA to withdraw its pipelaying vessels when all but 160 kilometers of the link was in place. When Nord Stream 2 started construction again, Russian vessels were deployed to lay 2.6 kilometers in Germany’s exclusive economic zone. In January 2021 work resumed on the Danish section. read more

    The oil major’s Netherlands-registered holding company and a Nigerian unit filed a case at the World Bank’s International Centre for Settlement of Investment Disputes on Feb. 10, according to the Washington-based organization’s website.     (Bloomberg) — Royal Dutch Shell Plc will not raise salaries for most of its employees this year, according to people with knowledge of the matter, as it looks to save cash amid an overhaul of the company.

    In a note to staff, Chief Executive Officer Ben van Beurden wrote that while the company had previously told employees to have low expectations for salary increases, most wouldn’t get a salary increase this year.

    Shell is starting one of the biggest reorganizations in its history as it pivots from a century-long structure that prioritized oil and gas production. There will be as many as 9,000 job losses over the next two years, with cuts already announced in The Netherlands, the U.K. and Malaysia.     In a sign of how much the petroleum industry has shifted away from its mantra of growth and exploration, Shell said its oil production will fall by 1% to 2% a year. Assuming an annual reduction on the upper end of that range, the oil major’s production would fall by 18% by the end of the decade. Output of “traditional fuels” will be 55% lower by 2030. read more
