Groningen earthquakes: Shell trying everything to deny responsibility

Comment by a Dutch farmer in relation to the article The Abrupt Demise Of Dutch Gas

In this article, I miss the human rights factor, and the fact that governments are in the first place for the safety and protection of property of their inhabitants.

The current situation is that government and SHELL have completely destroyed many hundreds of beautiful historical farms and churches, and 100.000 houses in the area are severely damaged, to be destroyed as well in years to come if the gaz exploitations continues in Groningen.

After all the destruction in the area, the bill is for the home owner. The compensated value is only 95% after their house is damaged many times, and already half the value. read more

Kiobel: Latest Shell Lawyer Salvo in the USA Courts

By John Donovan

Printed below is the content of an OPPOSITION TO MOTION filed on 17 July 2017 by a bunch of very high priced lawyers acting for very high priced Shell lawyers Cravath, Swaine & Moore LLP in the US Court of Appeal.

Shell is battling behind the scenes to avoid, at all costs, handing over 100,000 items of potentially incriminating Shell internal discovery assembled years ago for the original Kiobel action against Shell in the US, which Shell managed to eventually evade on a jurisdiction issue decided by the US Supreme Court. read more

Shell complicit in excessively violent action by the Nigerian regime

Extract: Shell contributed to the ‘Umuechem massacre’: In 1990, Shell’s request to the authorities to terminate a peaceful demonstration in Umechem, a village just outside of Ogoniland, resulted in a two-day long punitive expedition by MOPOL. Dozens of people were killed, even more injured and many hundreds became homeless. Extract: MOPOL returned very early the next day to undertake a punitive expedition in Umuechem. During this expedition, 495 houses were set alight in their entirety. Many people got injured and internal Shell documents as well as a Human Rights Watch report speak of a death toll of 80.

Kiobel Writ: PROCEEDINGS IN THE UNITED STATES

The defendants were accused of complicity in various human rights violations and crimes committed against the Ogoni in Nigeria, including summary executions, crimes against humanity, torture, inhuman treatment, arbitrary arrest and detention, criminally negligent homicide, indecent assault and ill-treatment. In the case against Royal Dutch/Shell it was also argued that the company acted contrary to the Racketeer Influenced and Corrupt Organizations (RICO) Act. On 8 June 2009, with the trial on the point of starting, Shell and the claimants agreed an out-of-court settlement. Shell paid the claimants a sum of $15.5 million in damages.

PROCEEDINGS IN THE UNITED STATES

5.1 Introduction

120. Following the execution of their husbands, the claimants were subject to constant threats and harassment by the Nigerian regime.162 Esther Kiobel, like many other Nigerians who became victims of Shell and the military regime, resettled in the United States from the refugee camp in Benin. In the United States two groups of victims and surviving dependants demanded damages from Shell in a civil action. The Saro-Wiwa case ended in an out-of-court settlement (see section 5.2). In the case brought by inter alia claimant 1, Esther Kiobel, the American Supreme Court ultimately did not consider that the American courts had jurisdiction to judge the case (see section 5.3). read more

Kiobel lawyers active in US and Dutch litigation

By John Donovan

Over 100,000 Shell internal documents assembled by Shell in relation to a thwarted legal action brought against Shell by Esther Kiobel over a decade ago are the subject of a ferocious legal battle. In the mean time, they are stored under the control of Shell lawyers in a secure US warehouse at an undisclosed address. Esther holds Shell responsible for the murder of her husband Dr Barinem Kiobel – one of the ‘Ogoni 9‘. Shell’s US lawyers are currently appealing a US federal court decision that Esther Kiobel should be given access to the discovery in connection with the same human rights case she is bringing against Shell in the Netherlands. read more

Embarrassing facts Shell omitted from its history

Extract from page 10 (with our amendments in italics)

HISTORY

From 1907 until 2005, Royal Dutch Petroleum Company and The “Shell” Transport and Trading Company, p.l.c. were the two public parent companies of a group of companies known collectively as the “Royal Dutch/Shell Group”. In 2005, the Donovan’s beat us to the domain name “RoyalDutchShellGroup.com” and we lost a costly legal battle to seize it.

Operating activities were conducted through the subsidiaries of these parent companies. In 2005, Royal Dutch Shell plc became the single parent company of Royal Dutch Petroleum Company and of The “Shell” Transport and Trading Company, p.l.c., now The Shell Transport and Trading Company Limited. In 2005, the Donovan’s beat us to the domain name “RoyalDutchShellPlc.com” and we lost a costly legal battle to seize it. Esther Kiobel vs money motivated hornets’ nest of 66,000 lawyers

By John Donovan

The battle in the US courts over Shell discovery documents was uneven from the start. Esther Kiobel versus Shell’s formidable US lawyers CRAVATH, SWAINE & MOORE, LLP. The Nigerian-born widow of a murdered Ogoni leader on one side, still fighting to put Shell on trial for complicity in his murder, and a giant law firm on the other, which since 2002, has been blocking her path to justice.

Nonetheless, a US Judge granted her recent petition for Cravath to hand over more than 100,000 Shell discovery documents stored in the USA so that Esther can use them in a pending action against Shell in the Netherlands. In response, Cravath hired another top law firm Hogan Lovells led by one of America’s top lawyers Neal Katyal to represent them in an appeal, thus becoming a battle between Esther Kiobel (now a US citizen) and two giant law firms. No doubt with the malevolent presence of Shell lurking behind the scenes pulling the strings. read more

The Uncensored History of the Shell Brent Oil and Gas Field

screen-shot-2016-11-09-at-20-34-36

By John Donovan (updated 18 November 2016)

Energy Voice has announced that it has teamed up with Shell to “celebrate 40 years of Brent”.

A series of related “promoted” articles are being published. I take that as meaning Shell is paying for the articles. If this assumption is correct, the only history included will be of the whitewashed variety.

I doubt there will be any reference to the consequences of Shell’s appalling safety record on the Brent platforms, with falsified safety records, a “Touch F*** All” regime in regard to critical equipment maintenance, followed by the cover-up and the deaths on Brent Bravo, leading to a record-breaking fine. Will the unseaworthy lifeboats get a mention? Of course not. Shell continued to put production and profits before safety. Just read this index of related articles. read more

Shell historians attempt to distance Deterding from Hitler

screen-shot-2016-10-24-at-14-26-11EBOOK BY JOHN DONOVAN: SIR HENRI DETERDING AND THE NAZI HISTORY OF ROYAL DUTCH SHELL

Chapter 16: Shell historians attempt to distance Deterding from Hitler

screen-shot-2016-11-04-at-15-00-13

Shell’s historians downplayed the relationship between Hitler and Deterding. As far they are concerned, the two never met. They said that a request by Sir Henri for a meeting with Hitler in March 1933 was rebuffed and disregarded Deterding’s claim that he met with Hitler in November 1933.  Not only were there meetings. Deterding “was revered and ultimately mourned by Hitler.”

Shell’s historians portrayed the relationship between Deterding and Hitler as standoffish on the part of Hitler, with all of Deterding’s attempts to meet with him being rebuffed. See pages 481 to 485 of RDSH V1. read more

Shell collaborated in the Nazi annexation of Austria and occupation of Czechoslovakia

Chapter 11: Shell collaborated in the Nazi annexation of Austria and occupation of Czechoslovakia

screen-shot-2016-10-27-at-17-07-50

German forces entered Vienna on 17 March 1938 (above). The Nazis annexed Austria in what became known as the Anschluss and occupied Czechoslovakia a year later. Royal Dutch Shell authorized its German subsidiary Rhenania-Ossag, to take over Shell operating companies in both countries.

Being one of the two biggest German oil concerns and the main lube oil manufacturer, Shell subsidiary Rhenania-Ossag was an industry leader in Nazi Germany. Many of its directors and staff were Nazis.

Following Hitler’s annexation of Austria on 12 March 1938 (photo) and the Nazi occupation of Czechoslovakia in March 1939, Dutch directors of Royal Dutch gave approval to Rhenania-Ossag taking over the Shell operating companies in those countries. read more
