Noy faces graft suit over Shell

FORMER President Benigno Aquino III is facing graft charges before the Office of the Ombudsman for allegedly failing to collect P100 billion in taxes from Pilipinas Shell Petroleum Corp.  for gasoline shipments in 2004 to 2009.

Also charged were ex-Finance secretary Cesar Purisima, PSPC chairman and president Edgar Chua, ex-vice president for communications Robert Kanapi and country tax manager Nigel Avila.

The complainants–ex-Customs commissioner Napoleon Morales, former district collector Juan Tan and Headlines News Today publisher Lourdes Aclan–accused Aquino, Purisima and the other respondents of violating the Anti-Graft and Corrupt Practices Act and the Tariff and Customs Code. read more

Shell, Philippines’ $1.2B Tax Dispute Heads To World Bank

Law360, Washington (July 21, 2016, 6:30 PM ET) — A Royal Dutch Shell PLC unit on Wednesday took its $1.2 billion tax recalculation dispute with the Philippines’ Commission on Audit over the gas-to-power Malampaya project the company operates to a World Bank arbitration dispute body.

The International Centre for Settlement of Investment Disputes records show that Shell Philippines Exploration BV initiated the arbitration proceedings, registered Wednesday, against the Republic of the Philippines over the taxation of a hydrocarbon concession. read more

Royal Dutch Shell supports relief efforts for typhoon Sendong victims

Royal Dutch Shell plc said today that it is donating US$1 million, in response to the catastrophic typhoon Sendong (international name typhoon Washi). The deadliest cyclone to hit the Philippines in the last 12 years, typhoon Sendong left over a thousand people dead in the provinces of northern Mindanao and billions worth of infrastructure and agriculture in ravages.

The donation from Royal Dutch Shell will be used for rehabilitation efforts in the areas badly hit by typhoon Sendong, as a way of providing long-term assistance for the affected communities. read more

The Court of Appeals has calendared for hearing a pending petition of Pilipinas Shell Petroleum Corp. questioning a Manila regional trial court’s resolution that ordered the Big Three oil companies to open their books of account to government audit amid allegations of price fixing.

In setting the hearing for Jan. 17, the appellate court cited the “far-reaching effects to the public” of Shell’s petition that seeks to void the April 27, 2009, order of Manila RTC Branch 26 Judge Silvino Pampilo. read more

Shell Philippines Exploration B.V. remains interested in bidding for other oil and gas prospects even as it pulled out of one of its work sites, the Energy department yesterday claimed.

The government said the withdrawal of Shell from service contract 54B is to allow the firm to look at more sites in the country.

“Shell has expressed to the Energy department its continued interest in exploration opportunities in the Philippines and will bid for new areas,” said Energy Undersecretary Jose M. Layug in a text message. read more

Oil spill in the Philippines

Dear Mr. Donovan,

I am a resident of Bangkal village in Makati City, a working-class neighbourhood in the Philippines.

I wish to tell you that Shell and Chevron have done a great environmental damage to our ground, but have kept quiet about it all this time.

A month ago, an oil spill was discovered in our area, where a pipeline runs under it. The spill is said to have been going on unnoticed for some months. The pipeline carries Shell and Chevron products. Our government has somewhat penalized the pipeline operator, First Philippine Industrial Corp. (which is incidentally 40% owned by Shell Petroleum). But the owners of the spilled fuel have yet to own up to the mess. read more

THE PHILIPPINE GOVERNMENT WILL HAVE to resolve existing taxation issues involving the Shell Group of Companies here if it expects to see more Dutch companies investing in the country.

Ric Hettinga, the Royal Netherlands Embassy deputy chief of mission, said in a recent interview that the less obstacles to investing here, particularly with regard to taxation, the better chance there was of Dutch firms bringing their businesses into the Philippines.

“We will be happy if taxation would be such that Dutch companies can operate here,” Hettinga told reporters. read more

A MAJOR oil company could still be held liable for the gas leak that caused an explosion in Quezon City on Sunday, although it had agreed to shoulder the medical expenses of victims and the repair of damaged property.

The Quezon City fire department said it would file charges of reckless imprudence resulting in damage to property and physical injuries against Shell and Darnel Imbo, driver of the leaking tanker, when the victims filed their affidavits. read more

PUMP prices of petroleum products can still go up in the next several weeks, with or without an increase in import tariffs or excise taxes.

The Independent Philippine Petroleum Companies Association — which groups “new players” in the industry dominated by the Big Three companies Petron Corp., Pilipinas Shell Petroleum Corp. and Caltex Philippines Inc. — said the new players, which are all importers of finished products, still had to recover costs of 0.78 peso a liter for unleaded gasoline and as much as 3.81 pesos a liter for diesel. As this was the case, pump prices had nowhere to go but up, the group said. read more

CONSUMERS are expected to be burdened with higher oil prices as local pump prices of fuel are expected to increase anew by next week.

On Saturday, Caltex (Philippines) Inc., Eastern Petroleum Corp., Flying V, Pilipinas Shell Petroleum Corp. and Seaoil Philippines Inc. announced that they would be increasing oil prices by 50 centavos a litre for gasoline, diesel and kerosene.

The latest round of oil price hikes would take effect midnight of Sunday (August 2), except for Flying V, which is set to raise its own prices by midnight of Monday (August 3). read more
