Vanguard (Nigeria): Court insists on hearing Arms company suit against Shell

LAGOS—A Federal High Court sitting in Lagos, yesterday, insisted on hearing the 11 years old suit brought by X.M Federal, an International Arms Company, in which the company had sued Shell Petroleum Development Company, over the termination of its contract to supply arms to the oil company. The court said it will hear the case today.

Counsel to Shell, had at the resumed hearing in the matter, drawn the attention of the court to an application, in which they had sought for extension of time to amend their statement of defence. Counsel to the plaintiffs, however, argued that the application was meant to delay the case. In response, counsel to Shell said that an application for extension of time to amend can not be said to be a delay tactics.

Presiding judge in the matter, Justice Abdulahi Mustapha, however granted the application to amend, insisting that the court will hear the case today.
