When I forecast yesterday an increased flow of leaked Shell emails, I had not anticipated that the next one would follow within hours. I supplied a copy to its author, Richard Wiseman, early this morning and gave him a 4 pm deadline in relation to its authenticity as indicated in my somewhat tongue-in-cheek email printed below.  Since it bears all the hallmarks of a Shell management email, being bureaucratic and boring, and because I already know it is authentic having received copies from multiple insider sources, I am publishing without waiting for the deadline to pass.

If Mr Wiseman is capable of a witty response (I’m not sure he has a good sense of humour), I will insert it if it arrives.

Dear Mr Wiseman

The leakage of Shell internal emails seems to be turning into a veritable flood. 

The latest to reach me is your own interesting email to Shell colleagues, as printed below. I would have been stumped if it was just in Dutch, but fortunately you kindly provided an English translation. 

For security reasons that you will appreciate, I have deleted some of the header information. 

It is a delicious irony that the subject of the leaked email itself relates to the security of Shell emails, including those containing sensitive information. 

Could you kindly confirm if the email is authentic? If I hear nothing by 4pm UK time today, I will assume that it is. 

It is reassuring to learn that Shell Centre has already implemented the new programme allowing easy retrieval of archived email, which you say is being rolled out in the Netherlands on 1 March. This will presumably make it easier for Shell to handle my next SAR application.

It would speed up the publication of Shell emails on our website if you could simply put us on the distribution list for all Shell high level emails. We could then cut out the middlemen in our mutual quest of promoting Shell transparency.

Beste collega’s,

Met dit bericht wil ik u op de hoogte brengen van de invoering in Nederland van ‘E-mail journaling’. De maatregel gaat in op 1 maart a.s. en geldt in eerste instantie voor medewerkers in jobgroep 2 en hoger van Shell-maatschappijen in Den Haag en Rijswijk.

Bij E-mail journaling wordt de inhoud van alle e-mailverkeer vastgelegd. Dit zal ons helpen bij de uitvoering van de Groepsstandaard voor Records Management. Daarnaast kan het dienen bij het openbaar maken van e-mailberichten bij eventuele rechtsvervolging en onderzoek door regelgevende instanties.

Hoewel er momenteel wel back-ups van e-mail worden gemaakt, heeft het nu in gebruik zijnde systeem tot gevolg dat meerdere kopieën van door Shell-medewerkers verzonden en ontvangen e mail in meerdere, gedecentraliseerde locaties worden opgeslagen. Het doorzoeken en beoordelen van enorme volumes e-mail met het huidige systeem is duur, inefficiënt en misschien niet volledig betrouwbaar. E-mail journaling is de meest effectieve en veilige methode om dit probleem op te lossen. Het stelt ons in staat om de e mail van de organisatie centraal te beheren en te archiveren. De gearchiveerde elektronische berichten kunnen vervolgens efficiënt worden gelokaliseerd, bewaard en opgehaald.

Met E-mail journaling wordt elk e-mailbericht dat de medewerker ontvangt of verzendt vanuit diens mailbox naar een apart archief gekopieerd. Als een gebruiker een kopie van een specifiek e-mailbericht wist of wijzigt, blijft de gearchiveerde kopie ongewijzigd omdat het E-mail Journal-archief niet afhankelijk is van lokale opslag. Op basis van een grote hoeveelheid reacties naar aanleiding van proeven die zijn genomen, blijkt dat deze wijze van archiveren van minimale invloed op gebruikers is en hun persoonlijke gebruik van Shell e-mail niet vertraagt of belemmert Gebruikers kunnen hun e-mailberichten in hun eigen systeem, in pst-bestanden of via andere methoden blijven opslaan.

Het journal-archief wordt bewaard en beveiligd op een T-Systems-server in de Europese Unie, overeenkomstig het beleid en de procedures van de Shell Groep. De toegang tot het archief is aan strenge beperkingen onderhevig. Alleen met naam genoemde, specifieke personen, aan wie per geval administratieve rechten worden verleend in combinatie met toestemming van Legal Services, HR en Compliance, krijgen toegang tot de informatie in het archief en dan nog uitsluitend met het beperkte oogmerk van: (i) voldoen aan verzoeken om potentieel relevante e-mailberichten uit hoofde van rechtsvervolging of onderzoek door de wetgever, (ii) openbaarmaking van informatie aan regelgevende instanties, (iii) hulp in verband met onderzoek door Shell Business Integrity Services van vermeende inbreuk op de Algemene Beleidsuitgangspunten of de Gedragscode van Shell of op de wetgeving Niemand anders, ongeacht welke reden hij aanvoert, krijgt toegang tot e-mailberichten in het archief. Het e-mailarchief is niet bestemd voor reguliere HR-doeleinden, als back-up voor verloren gegane e-mailberichten of als opslagfaciliteit voor persoonlijk gebruik.

Op termijn wordt e-mail journaling wereldwijd bij Shell ingevoerd. Het is inmiddels in Houston en Londen in gebruik. In Nederland geldt de introductie in eerste instantie voor alle medewerkers in JG 2 en hoger in bovengenoemde locaties. Dit zijn degenen bij wie de kans het grootst wordt geacht dat hun e-mailinformatie gevoelig materiaal bevat E-mailcorrespondentie met medewerkers in JG 2 of hoger wordt onderdeel van het e-mailarchief. Ons uiteindelijke doel is om journaling volgens een door Legal, HR en IT te adviseren tijdschema voor alle Shell-medewerkers in te voeren.

Dear colleagues,

I am writing to tell you about the implementation of E-mail journaling in The Netherlands for employees in Job Group 2 and higher, working for Shell companies in The Hague and Rijswijk. E-mail journaling will commence on March 1, 2009.

E-mail journaling is a tool to help us implement the Group Standard on Records Management and is designed to support disclosure of e-mails in the event of litigation and regulatory investigations.

Although e-mail is presently backed up, the current system results in multiple copies of e-mails sent and received by Shell employees being stored in multiple, decentralised locations. Searching through and reviewing huge volumes of e-mail using the current system is expensive, inefficient and may not be fully reliable. E-mail journaling is the most effective and secure method of solving this problem. It will allow us to manage and archive the organisation’s e-mail centrally. Archived e-mails can then be efficiently located, preserved and produced.

With the addition of E-mail journaling, an e-mail will be copied into a separate archive as it leaves or arrives at an individual’s mailbox. If a user deletes or alters a copy of a specific e-mail, the archived copy is unaffected, since the e-mail journal is not dependent on local storage.  Based on significant pilot testing feedback, archiving in this way has minimum impact on users and does not slow down or inhibit their personal use of Shell e-mail. Users can continue to store their e-mails in their own system, in pst files or by other methods.

The journal archive will be held securely on a T-Systems server within the European Union, in accordance with Shell Group policies and procedures. Access to the archive is severely restricted. Only specified persons with administrative rights granted on a case by case basis, together with consent from Legal Services, HR and Compliance, will be able to access information in the archive and then only for the limited purposes of: (i) responding to requests for potentially relevant e-mails for litigation or legislative investigation reasons, (ii) disclosure of information to regulatory authorities or (iii) in connection with Shell Business Integrity Services’ investigations of alleged breaches of the Shell Business Principles, the Shell Code of Conduct or applicable law. No other individual will have access to e-mails in the archive for any purpose. The e-mail archive is not available to support regular HR purposes, as a backup to recover lost e-mails, or as a storage area that can be accessed for personal use.

E-mail journaling will eventually be implemented within Shell globally. It has already been implemented in Houston and London. In The Netherlands, the roll out will initially cover all employees holding JG2+ positions in the above mentioned locations. Those are persons with e-mail information judged to be most likely to contain sensitive material. Email correspondence with employees holding JG2+ positions will become part of the email archive. Ultimately, we intend to apply journaling to all Shell employees on a timetable advised by Legal, HR and IT.
