Nigeria’s Lawsuits Against Shell Could Cause Oil Major Exodus

Judging from recent headlines, Nigeria has unleashed one of the most spectacular legal attacks on one of its key oil and gas investors, to an extent previously unseen in the country’s more than 60 years of hydrocarbon production. Shell has been active in Nigeria ever since the African country opened up to international investment in the early 1960s, maintaining its position as one of the leading actors in its upstream segment, accounting for roughly 10% of Nigeria’s crude production. Seemingly, the timing is quite inopportune for a large-scale feud – projects are getting delayed and drilling contracts cancelled, Nigeria’s GDP dropped 2% in 2020 just as was bouncing off its period of economic lassitude and OPEC+ production curtailments limiting the potential output of Nigerian producers. Despite the odds, the conflict between Nigeria and Royal Dutch Shell might be a harbinger of great transformations, not necessarily to the benefit of either side. read more

 Nigerian court rejected Royal Dutch Shell Plc’s bid to overturn an order restricting access to the company’s bank accounts in the West African country, a spokesman said.

Aiteo Eastern E&P Co. obtained an injunction from a federal court in Lagos on Jan. 25 directing Shell and multiple Nigerian banks not to let the oil major withdraw funds “without first preserving or ring-fencing” almost $2.8 billion. A judge refused Shell’s application to vacate the order at a hearing on Tuesday, according to a spokesman for the company’s Nigerian unit. read more

Anti-corruption groups write Buhari, IG, fault Adoke on OPL 245 fraud charges 

An international coalition of anti-corruption groups has asked the Inspector General of Police, IG, Adamu Abubakar, to dismiss request for fresh investigation made by former Attorney General and Minister of Justice, Mr Mohammed Adoke, on the OPL 245 oil fraud. Adoke had asked the IG to investigate the source of an important email that nailed him saying it was a red herring.

The coalition made up of Re-Common, The Corner House Human & Environmental Development Agenda, (HEDA) and Global Witness said a copy of the petition signed by Executive Director, Re-Common, Mr Luca Manes, was sent to President Mohammadu Buhari last week. read more

The article listed some of the growing numbers of lawsuits being brought against Shell in multiple legal jurisdictions, all arising from Shell’s deplorable conduct in Nigeria.

The damaging global news coverage reporting on the various court actions seems to have stung Shell’s CEO Ben van Beurden into threatening that Shell may pack its corporate bags and pull out of Nigeria. read more

A Federal High Court in Abuja has rejected moves by the Federal Government, Shell Nigeria Exploration, Nigeria Agip Exploration Company and others to prevent the hearing of a suit seeking to reclaim the Oil Prospecting License (OPL) 245 originally awarded to Malabu Oil and Gas Limited.

The suit, marked: FHC/ABJ/CS/201/2017 was filed in the name of Malabu Oil and Gas Ltd by Mohammed Sani Abacha, son of the late Head of State, Sani Abacha, who claimed to be the majority shareholder of the oil firm. read more

MILAN (Reuters) – Italian judges are expected to hand down their verdict on Shell and Eni in one of the oil industry’s biggest-ever corruption trials at the end of March, a top court official said on Wednesday.

Marco Tremolada, president of the judges that will pass sentence, said lawyers for the two companies would be heard in January, followed by prosecutors and defence lawyers in February.

A final decision could then be reached by the end of March, he said. read more

The timing of the 1MDB operation and specifically the purchase of Coastal Energy by Abu-Dhabi owned CEPSA and the 1MDB Chinese middleman Jho Low was chosen to coincide exactly with the historic expiration of the 75 years old Abu-Dhabi oil concessions. read more
