BLACKMAILING SHELL: DEFAMATION THREAT FROM OSSL

Mr Donovan ,

We at OSSL would like to caution you as the editor of your Shell Blog, about the use of the term blackmail in the matter headlined above.

There is no question of OSSL attempting to blackmail Shell, we would point you in the direction of this fact ….the monetary ingredient in this dispute is not a demand for cash from Shell ….which is Shells cash …..it is a demand for the return of our cash laid out on Shells behalf at their demand to satisfy purchases for covert items of which “police alcohol” and “tennis courts” are only part of the whole picture .

Many unsuccessful meetings ( 7 in all ) have taken place with Shell about the alcohol, all at a very senior level dating back to August 2009 …..varying degrees of comfort were offered at the original meeting about payments and a time frame was requested by CEO Terry Nolan in which he would resolve the matter which he described as “very very serious matter for Shell”….his request for two weeks in which to resolve was a hollow assurance, and the fact that he never spoke with us again tells you all you need to know about Shell integrity .

It is worth noting that at no time have Shell in the course of seven meetings said “with regard alcohol claims by you at OSSL instructed by Connor Byrne of Shell ….it didn’t happen “rather the theme at the meetings has been “we will find a way to sort this “.

Mr Donovan we are aware that you have highlighted our plight at the hands of a almost unbreakable cover up by both police and Shell, and you have facilitated our meetings with two CEOs in Den Haag …for that we are grateful ….however I would ask you to accept that whilst we have explored every possible avenue to resolve this matter with Shell …Blackmail is not one of them .

Your own solicitor Marc Fitzgibbon has already advised that you have no legal claim against Shell for anything.

I have already published his written advice to you on that specific point.

You signed the all claims full and final settlement with Shell over two years ago.

This is the agreement which Shell has reminded you about many times.

As to the implied threat of a defamation action, I would welcome the opportunity for these matters to be scrutinised in open court.

It would have to be in the UK as you and I are both UK citizens resident in the UK and I have no plans to visit Ireland.

I assume that it would be possible to subpoena witnesses.

Would likely be a revealing and entertaining event, especially for the news media.

You already have the name and address of my solicitor for service of proceedings.
