In today’s episode of “Shell’s Next Big Environmental Screw-Up,” the oil giant is seeking government permission to drill up to five offshore wells off the west coast of South Africa. That’s right, folks—because clearly, our oceans aren’t polluted enough, and the wildlife isn’t nearly as threatened as it could be.

According to a draft scoping report from environmental consultancy SLR, Shell Offshore Upstream South Africa B.V. and its partners are eagerly awaiting the green light from the government to start wreaking havoc in the Northern Cape Ultra Deep Block (NCUD) in the Orange Basin. This region’s depths range from 2,500 to 3,200 meters—perfect for deep-sea drilling and even deeper levels of corporate irresponsibility. read more

In a shocking display of corporate greed and utter disregard for the environment, Shell, the infamous oil giant known for its ruthless pollution tactics, is hell-bent on drilling for oil and gas off the South Africa Wild Coast in the Eastern Cape.

This week, the Supreme Court of Appeal (SCA) upheld a ruling by the high court in Makhanda, ordering Shell to pause its voracious plans until it has “sufficiently consulted” the communities that will be directly impacted. Because, you know, consulting the locals whose lives you’re about to wreck is apparently an afterthought for Shell.

“It is not in dispute that neither the public was given notice of the decisions or informed of the right to appeal. The failure to do so, which is unexplained on the papers, is subversive of the procedural entitlements of the appellants,” reads the SCA judgment. read more

Shell’s Seismic Tantrum: Court Smacks Down Oil Giant’s Appeal But Leaves Door Open for Another Round of Environmental Nonsense

Environmental Activists Win Against Shell In Appeal Court

In a classic case of corporate shenanigans, Shell and their cronies at Impact Africa, along with the Department of Mineral Resources and Energy (DMRE), just had their appeal smacked down by the Supreme Court of Appeal (SCA). Their aim? To overturn a High Court ruling that halted their oh-so-important seismic survey off the Wild Coast. Why the halt? Apparently, “community participation” was more of a bad joke than a reality.

The SCA dismissed their appeal with costs and pointed out that the so-called community involvement was downright “illusory.” Translation: Shell’s idea of consulting the local communities was about as real as a unicorn. But hold onto your hats, because the court did leave a teeny-tiny crack open for Shell and Impact Africa to make a third attempt to renew their 2014 exploration rights. Of course, this time, they actually have to talk to the people whose lives they’re screwing over. read more

A South African court has upheld a ban imposed on the energy giant Shell from using seismic waves to explore for oil and gas off the Indian Ocean coast.

The judgment delivered in Makhanda on Thursday marks a monumental victory for environmentalists concerned about the impact the exploration would have on whales and other marine life.

The 2014 decision granting the right for the “exploration of oil and gas in the Transkei and Algoa exploration areas is reviewed and set aside”, the high court ruled in the southern city. read more

A new gas field in the North Sea has finally been given the thumbs up by regulators in a move Business Secretary Kwasi Kwarteng claimed will ‘protect energy security’.

The Jackdaw field, east of Aberdeen, is owned by Shell and was originally licensed in 1970.

Last year the Government refused permission to develop it amid opposition from green activists who were pressuring ministers to reduce Britain’s reliance on fossil fuels.

But that decision was called into question following Russia’s brutal invasion of Ukraine, which has caused gas prices to soar as countries shun supplies from the Kremlin. read more

Judgment reserved in case against Shell’s seismic survey along the Wild Coast

The second day of the three-day court case between Shell, Impact Africa and environmental activists kicked off at the Gqeberha High Court on Tuesday following arguments from advocate Tembeka Ngcukaitobi SC and advocate Nick Ferreira on Monday.

The judges adjourned the matter, reserving judgment in both granting the joinder application put forward by Natural Justice and Greenpeace Africa (represented by the environmental law firm Cullinan & Associates) and the declarator that Shell required an environmental authorisation under the National Environmental Management Act (Nema), and if their exploration rights had been lawfully awarded by the Department of Mineral Resources and Energy (DMRE).

On Monday, Judge President Selby Mbenenge, Deputy Judge President Zamani Nhlangulela and Judge Thandi Norman heard the merits of the joinder application.

On Tuesday, Jeremy Gauntlett SC, representing Impact Africa, argued against the joinder application sought by Natural Justice and Greenpeace Africa, saying the two organisations added nothing new to the case and had decided to attach themselves like a “cuckoo in a nest”.

During the second day, Gauntlett argued that the applicants were using a legal “knobkerrie” via interdict to undermine Minister Gwede Mantashe’s  authority to decide the matter, laying blame on imperfect legislation rather than the decision-maker. read more

Shell has terminated the contract for the Amazon Warrior survey vessel emphasizing the court victory of local activists over the oil major’s seismic plans along South Africa’s Wild Coast.

The owner of the vessel, Shearwater Geo, said in October 2021 that it had won a major 3D seismic exploration project in South Africa. Under the deal, the seismic firm was supposed to acquire just over 2,300 square miles of data during a four-week project. Shell has suspended seismic exploration activity off South Africa’s east coast, terminating a contract for the Amazon Warrior survey vessel after a High Court ordered it to pause work after a legal challenge by environmental groups.

A court in South Africa has halted oil giant Shell’s exploratory offshore seismic surveys in the latest ruling in a case brought by campaigners arguing the activity causes “irreparable harm” to the marine environment.

The new ruling forms part of a broader legal case contending that Shell did not have the necessary environmental approvals to continue with their surveys.
