Shell’s troubled Prelude floating LNG operation has acquired another legal complication.

The Industrial Magistrates Court of Western Australia is now listing two separate proceedings brought by the Australian Workers’ Union against Shell Australia FLNG Pty Ltd, the Shell entity associated with the Prelude project.

At first glance, the latest OnNotice report sounds straightforward: two workers aged over 55 asked for flexible working arrangements, Shell refused, and the Fair Work Commission backed the company.

The actual decision is more complicated.

The Commission did not determine that Shell’s operational objections were necessarily reasonable, nor did it establish that reduced-hours working at Prelude is inherently unworkable. Instead, Commissioner Hunt found that the two workers had failed at an earlier jurisdictional hurdle: their requests had not been validly made under section 65 of Australia’s Fair Work Act 2009 because the required connection between being aged 55 or over and the requested changes had not been established. The Incident

On July 12, the Shell-operated Shearwater platform, 140 miles off Aberdeen, sprang a leak of liquid nitrogen. The leak damaged the underside of the deck, sending debris crashing onto a walkway below. The Health and Safety Executive (HSE) later confirmed the falling material had the potential to cause a “fatal injury.”

Shell was served an improvement notice on August 4, with the HSE citing six separate breaches of health and safety law, including failures to protect workers from risks tied to “loss of containment events.” The notice must be complied with by September 9. read more
