PETROLEUM ECONOMIST: Eni and Shell face new Nigeria action

The Nigerian government’s decision to formally launch a $1.1bn claim against Shell and Eni in UK courts, relating to funds allegedly misappropriated for bribes and kickbacks during the acquisition of an oil block in 2011, could lead to the largest-ever payment in an oil sector corruption case.

If successful, the case, launched in November 2018, could also open the door for more scrutiny by governments of deals made by their predecessors in the hope of winning similar awards. Eni and Shell deny any wrongdoing related to the deal. read more

I heard from a major news organisation that Esther Kiobel brought up my name several times during an interview at the Dutch court hearing yesterday, kindly expressing her thanks for my help.

Esther approached me after the US Supreme Court decision that thwarted on jurisdiction grounds her attempts to sue Shell in the USA for complicity in the murder of her husband, Dr Barinem Kiobel. It took over a decade of litigation to arrive at that decision. read more

Nigerian widows sue Shell for complicity in activist deaths

The widow of a Nigerian activist executed by their country’s government more than two decades ago accused oil giant Shell of complicity in his death at a civil case in a Dutch court Tuesday.

“Shell came into my life to make me a poverty-stricken widow,” Esther Kiobel told judges at a one-day hearing.

“With this case I seek justice for my murdered husband so that he can be exonerated from a crime he never committed,” she added. read more

Esther Kiobel is testifying in court in The Hague, demanding compensation from the Netherlands-based firm.

Traumatised Nigerian widows confront Shell in Dutch court

The widows of four Nigerian activists executed by the military regime in the 1990s launched a court case in the Netherlands Tuesday against oil giant Shell for complicity in their deaths.

Esther Kiobel, whose husband Barinem was hanged in 1995 along with famed writer Ken Saro-Wiwa and seven others, said the “horrible” experience had left her “traumatised”.

The widows allege that Anglo-Dutch Shell helped in the arrest of the men, who had sought to peacefully disrupt the oil giant’s work in Nigeria’s Ogoni region because of health and environmental impacts.

Shell said it was “inconceivable” that it could have been involved in the death of the men.

Kiobel and one of the other widows, Victoria Bera, were in court in The Hague for opening arguments in the case against Shell, while the other two women whose husbands were killed were denied visas to attend.

“My husband had a good heart. Now I am a poor widow who has lost everything,” Kiobel was quoted as telling the court in The Hague by Dutch news agency ANP.

“The abuses that my family and I went through were a horrible experience that has traumatised us to this day,” added Kiobel, who fled Nigeria in 1998 and now lives in the United States. read more

Netherlands: After 23 years, appalling allegations against Shell to be heard in court

A Dutch court will today hear the first arguments in a historic case against Shell, in which the oil giant stands accused of instigating a raft of horrifying human rights violations committed by the Nigerian government against the Ogoni people in the 1990s. Esther Kiobel, Victoria Bera, Blessing Eawo and Charity Levula are suing Shell over what they say is its role in the unlawful arrest, detention and execution of their husbands by the Nigerian military, following a brutal crackdown on Ogoni protests against Shell’s devastating pollution of the region.

Amnesty International, which is supporting the plaintiffs and legal team bringing the case, has independently documented Shell’s role in killings, rape and torture carried out by the Nigerian government in its effort to crush protests. Barinem Kiobel, Baribor Bera, Nordu Eawo and Paul Levula were hanged in 1995 after a sham trial. Their widows are now demanding compensation and a public apology from Shell. Five other men, including protest leader Ken Saro-Wiwa, were executed alongside them and they have become collectively known as the Ogoni Nine. read more

President of the Movement for the Survival of the Ogoni People (MOSOP), Fegalo Nsuke, has charged Ogonis to be prepared to save the Ogoni nation.

Addressing members of the MOSOP Steering Committee at the international head office of MOSOP in Bori, Ogoniland on Saturday, January 12, 2019, Nsuke said he was confident that the new team of MOSOP executives and affiliate heads can save the Ogoni nation from the discrimination of Nigeria and the death sentence of Shell’s massive pollution of over 50 years. “I will assure you that freedom for the Ogoni people is near. It doesn’t matter how much lies our detractors try to mislead the public about us, we must remain focused and committed to save our land and that is the way we can save Ogoniland” Nsuke told members of the Steering Committee yesterday. “I am confident we can save Ogoniland. If you see what I see, you will understand what I mean when I say that we can save Ogoniland” Nsuke said. We have a huge task because today over 50 persons die weekly in the coastal communities in Gokana alone and all that HYPREP is doing is to see what they can do to spend cleanup funds ahead of the 2019 elections, he said. Nsuke maintained that HYPREP is not implementing the UNEP report. “What HYPREP is doing is a scam. There is no way you can commence such a massive exercise without providing an alternative source of drinking water and having a way to manage the wastes. The report says there should be an integrated soil management center in place to manage the wastes from the sites but HYPREP now want to turn our communities into dumping sites and we will resist that very strongly” Nsuke said. Nsuke said there is nothing HYPREP is doing that is different from what Shell had been doing to us and that is what the UNEP report condemned. HYPREP is scamming us and we want to make it clear that they want to spend our cleanup funds and possibly create crises in Ogoniland.

The Ogoni Struggle is About Human Rights and Freedom

Shell, Eni: Partners in Crime

No, the headline is not referring to the OPL 245 oil deal in which former Shell and ENI executives and the companies themselves are currently on criminal trial in Italy on corruption charges.

Both companies have prior convictions for illicit joint activity that most people have forgotten.

In September 2006, the European Commission fined Shell $137m for their role in a cartel that fixed the price of bitumen. According to a report published in the Houston Chronicle“the EU Commission said the company was an instigator, took the leadership in the cartel and was a repeat offender”. The report went on to state that “Shell’s fine was increased by 50 percent because of its involvement in previous cartels and another 50 percent for instigating and leading the cartel.”  read more

It provides proof of the understandable great sensitivity attached to the criminal trials in Milan Italy stemming from the Nigerian OPL 245 corruption scandal.
