Parent company owes duty of care in transnational cases – Hague Court of Appea

Parent company owes duty of care in transnational cases – Hague Court of Appea

1 March 2021 by

The Hague Court of Appeal has recently handed down a ruling that is of profound importance to environmental lawyers. It is not only the first case at the appellate level in Europe that has resulted in a victory on the merits for the victims, but also the first case to hold that a parent company was under a duty of care with regard to foreign claimants. I will attempt to summarise one of the judgments in the following paragraphs, but readers would do well to look at the detailed analysis of the case by  Dr Lucas Roorda on the Rights as Usual blog: “Wading through the (polluted) mud: the Hague Court of Appeals rules on Shell in Nigeria”. read more

Shell’s woes over NIgerian Oil

By John Donovan

The BBC recently published an article under the headline: Shell’s legal woes over Nigeria’s oil.

The article listed some of the growing numbers of lawsuits being brought against Shell in multiple legal jurisdictions, all arising from Shell’s deplorable conduct in Nigeria.

The damaging global news coverage reporting on the various court actions seems to have stung Shell’s CEO Ben van Beurden into threatening that Shell may pack its corporate bags and pull out of Nigeria. read more

Shell moves to recover frozen bank accounts

Shell moves to recover frozen bank accounts

Shell Petroleum Development Company (SPDC) has said it is working to secure expeditious discharge of court order freezing its accounts, which was obtained by AITEO Eastern (E&P) Company Limited.

AITEO had sought an ex-parte order from a Federal High Court in Ikoyi, Lagos for an injunction directing 20 commercial banks to block accounts of SPDC and affiliates of the Royal Dutch Shell company operating in Nigeria in a bid to recover cash value of more than 16 million barrels of crude allegedly diverted by the oil giant. read more

Shell’s Nigerian accounts frozen in oil deal dispute

Shell’s Nigerian accounts frozen in oil deal dispute

Feb. 19, 2021 9:59 AM ET Royal Dutch Shell plc (RDS.A) By Carl SurranSA News Editor: 12 Comments

  • A Nigerian court has restricted Royal Dutch Shell’s (RDS.ARDS.B) access to its bank accounts in the country amid a legal dispute over a pipeline deal six years ago.
  • A local oil producer is demanding billions of dollars in damages, claiming Shell misrepresented the condition of the pipeline and undercounted the volume of crude one of its facilities received from the Nigerian company, Bloomberg reports, citing court documents.
  • The allegations involve its $2.4B purchase in 2015 of a 45% interest in an oil block and pipeline from three multinational companies, including Shell.
  • The dispute is just one among several related to Shell’s activities in Nigeria; YTD, a Dutch court has ruled Shell is liable for oil spills in two villages 13 years ago, and the U.K. Supreme Court allowed 40K fishermen and farmers to sue Shell in England.

Shell’s past sins in Nigeria catching up with the oil giant at last

The recent UK Supreme Court judgement represents a major defeat for Shell after decades of evading legal retribution for its evil plunder and pollution in Nigeria.

The crusading solicitors Leigh Day (London) – the scourge of errant corporations, brought the action against Shell on behalf of Nigerian communities impacted over many years by Shell’s horrific environmental legacy in Nigeria.

My help was sought by Leigh Day in bringing the action after Leigh Day discovered “invaluable” information on my website royaldutchshellplc.com.  read more

    12 FEBRUARY 2021

The UK Supreme Court has ruled that polluted Nigerian communities can sue oil giant Shell in English courts.

The decision is a victory for the communities after a five-year battle and overturns a Court of Appeal ruling.

The Niger Delta communities of more than 40,000 people say decades of pollution have severely impacted their lives, health and local environment.

Shell’s ‘Hard Look’ At Nigeria – All Bark No Bite

Shell’s ‘Hard Look’ At Nigeria – All Bark No Bite

Dilya Safine, CFA: Feb. 08, 2021 4:50 PM ET Royal Dutch Shell plc

    Summary

    • Shell’s comments on its Q4 call about “taking a hard look” at its onshore Nigeria assets prompted concerns that it might look to exit the region.
    • I estimate that its onshore Nigerian assets to be worth at least 6% of its stock price, as well as the backbone for its offshore and LNG expansions.
    • I believe that Shell’s comments are aimed at achieving more favorable terms for its other contract negotiations. More details at its Analyst Day.

Q4 Earnings: Comments on Nigeria Raise Alarms

On its 4Q’20 earnings call, Shell CEO Ben van Beurden called the company’s Nigerian assets a “headache” and said it is time to “take a hard look” at the company’s operations in the country. He cited frequent incidents of oil theft and operational challenges in the Niger Delta, blaming the leaks that his company had been forced to clean and compensate for on pipeline sabotage. These comments raised alarms that Shell (NYSE:RDS.A)(NYSE:RDS.B) might look to exit the country, and the stock fell as a result. RDS is expected to provide additional detail on its operations during its Strategy Day this week. However, I believe that the company is unlikely to halt its operations in the region, as it would have a material impact on its valuation and impact other areas of its business, as I explain below. read more

AMSTERDAM, Jan 29 (Reuters) – A Dutch appeals court on Friday held Royal Dutch Shell’s Nigerian subsidiary responsible for multiple oil pipeline leaks in the Niger Delta and ordered it to pay unspecified damages to farmers, in a victory for environmentalists.
