COVID-19: FG, Shell, Eni await new date for $1.1bn Malabu court case in Italy — Investigation

BARELY, a week after the London court had dismissed the $1.1 billion Malabu case, involving the purchase of Oil Prospecting Licence (OPL)245, on grounds of lack of jurisdiction, the court in Milan, Italy, has adjourned a similar case ‘to a yet to be announced date’ because of the negative impact of coronavirus pandemic.

An investigation by Vanguard showed that the adjournment of the case earlier slated for May 14, 2020, has kept the parties – FG, Shell and Eni – waiting.

When contacted, Dr. Umar Jibrilu, media aide, office of the Attorney-General of the Federation and Minister of Justice, stated: “The case was initially slated for the 14th May, 2020, but because of the coronavirus pandemic, it has been adjourned till a date to be communicated later.” read more

OilPrice.com: UK Judge Dismisses $1B Nigeria Bribery Case Against Eni, Shell

A UK judge dismissed on Friday a lawsuit against Eni and Shell brought by the Nigerian government alleging that the oil and gas supermajors knew about US$1.1 billion in bribes given to secure an oil license in Nigeria nearly a decade ago.

The judge in London dismissed the case on the grounds that the UK has no jurisdiction to try the lawsuit that is basically the same for which Shell and Eni are currently under trial in Italy, Bloomberg reported. read more

Reuters: UK court throws out Nigerian oil corruption case against Shell, Eni

LONDON — An English court threw out a $1.1 billion case Nigeria had brought against Royal Dutch Shell and Eni related to a dispute over the OPL 245 oilfield, a court document showed on Friday, while a related trial in Italy continues.

The Nigerian government filed the case in 2018 at a commercial court in London alleging payments made by the companies to get the OPL 245 oilfield license in 2011 were used for kickbacks and bribes.

Justice Butcher said in his ruling seen by Reuters that the High Court “must decline jurisdiction over the action against” Shell and the other defendants. read more

Details have emerged of how a Nigerian businessman and principal suspect in the Malabu OPL 245 scandal, Abubakar Aliyu, allegedly withdrew N24 billion ($60,593,000) in cash.

According to the transcript of a Milan court hearing held in 2018, but obtained recently by PREMIUM TIMES, Mr Abubakar, an ally of controversial former petroleum minister, Dan Etete, made the huge cash withdrawal from funds passed to him by Mr Etete, another suspect in the criminal trial.

Prosecutors believe that that magnitude of cash withdrawal does not have much precedence, raising suspicion that portions of the fund were used to bribe some officials of the Goodluck Jonathan government. read more

Two international oil firms, Shell and Eni, paid out about $1.1 billion to Nigerian government accounts in the UK which then transferred most of the money to Malabu, a company then controlled by Nigeria’s former petroleum minister, Dan Etete.

Two oil giants, Eni and Shell, have argued to stop or stay proceedings in a $1 billion lawsuit brought by the Federal Republic of Nigeria (FRN).

Virtual hearings in the case took place between Tuesday and Thursday during which the companies argued to halt the $1 billion English suit as duplicating the ongoing criminal trial and parallel civil claim being brought by Nigeria in Italy over the controversial OPL 245. read more

REUTERS: SEC drops inquiry into Shell’s OPL 245 deal, company says

LONDON (Reuters) – The U.S. Securities and Exchange Commission has dropped its inquiry into Royal Dutch Shell’s 2011 acquisition of an offshore oil block in Nigeria, the Anglo-Dutch company said on Thursday.

“The SEC has notified us that it has closed its inquiry into Shell in relation to OPL 245,” a Shell spokeswoman said.

On Wednesday, Italy’s Eni, which acquired the OPL 245 block together with Shell, said the SEC had also closed its investigation into its activity in Nigeria, as well as other activities in Congo. read more

The Italian government has re-nominated Claudio Descalzi as Chief Executive Officer of Eni, Italy’s largest multinational company and the country’s largest foreign oil producer in Africa.

Mr Descalzi is set to maintain the leadership role despite an ongoing criminal trial over corruption allegations surrounding the billion dollar 2011 acquisition by Shell and Eni of Nigeria’s OPL 245 oil license.

Italian prosecutors allege that the $1.1bn paid by Eni and their partner Shell for the OPL 245 licence was used to pay former Nigerian oil minister Dan Etete and was “intended for payment to a former Nigerian president, Goodluck Jonathan, members of the government, and other Nigerian public officials”. read more

These cases are important for what they mean for the individuals and communities involved. They could also set important precedents on the responsibility of companies for their overseas operations, which would open the way for further litigation not only against Shell but other multinational corporations as well.

They are also placing a much-needed spotlight on Shell’s business model in Nigeria.

Nigeria’s regulation of the oil industry is undoubtedly weak and lacks independence. Government agencies responsible for industry regulation and enforcement are under-resourced, ineffective and in some cases compromised by conflicts of interest. Its own courts have failed to offer the victims of human rights abuses a meaningful avenue for seeking justice for the oil spills that have blighted the Niger Delta and the lives and livelihoods of its communities. 3.3 THE “OPL 245” BRIBERY CASE

In 2018, Italian prosecutors brought a criminal case over the alleged involvement of Shell, and the Italian oil multinational Eni, in a 1.3 billion US dollar bribery scheme linked to the license of OPL 245. This is the name of one of Nigeria’s most valuable offshore oil blocks.

Thirteen individuals, including some current and former senior managers of Shell and the Italian oil company Eni, are currently on trial in Italy relating to how the two companies acquired the block in 2011.80 The defendants include both companies, a former Royal Dutch Shell Executive Board Member and two former MI6 agents who worked for Shell.81 read more

3.2.1 FOUR FARMERS’ CASES

The first of the pollution-related cases marked the first time that any Dutch company had been sued in the Dutch court for the operations of its subsidiaries overseas.

In 2008, four Nigerian farmers (Eric Barizaa Dooh, Fidelis Ayoro Oguru, Alali Efanga and Friday Alfred Akpan), along with Milieudefensie, the Dutch section of Friends of the Earth, filed claims against RDS and SPDC.44

They are seeking to obtain compensation for alleged damage to fish ponds and land caused by oil spills from two underground pipelines and an oil well operated by Shell in the villages of Goi, Ikot Ada Udo and Oruma between 2004 and 2007.45 read more

Malabu Scandal – Nigeria Loses Bid to Postpone London Trial

The Nigerian government on Monday lost a bid to postpone a massive claim against oil giants, Eni and Shell, in a London court.

Royal Dutch Shell and Eni’s bid to block a $1.1 billion civil claim over corruption allegations in Nigeria will go ahead next month, Mark Pelling, a judge in a London court ruled on Monday.

The court ruled that it should not wait for a connected Italian ruling.

Nigeria wanted the April court date postponed until January 2021, when a connected criminal case in Milan will have concluded. read more

EnergyVoice.com: Shell spills more oil, flares more gas in Nigeria

Spills in Nigeria for Shell increased to 2,000 tonnes in 2019, from 157 incidents, the company has disclosed in its annual report, up from 1,600 tonnes from 111 incidents in 2018.

These are predominantly a result of sabotage, the company said. Of the 164 spills of more than 100 kg of crude, 95% were the result of “illegal activities by third parties”. Flaring also increased in 2019 in Nigeria, by around 10%.

The number of spills caused as a result of its own operational issues fell to seven incidents, from 15 in 2018. This saw the volume of crude spilled fall to around 30 tonnes of crude, from 400 tonnes in 2018. Where there have been operational spills, SPDC pays compensation to people and communities. read more
