NUOS INTERNATIONAL UNHAPPY WITH “SETTLEMENT” IN WIWA V.SHELL OIL 

The attention of the National Union of Ogoni Students (NUOS INTL.), USA has been drawn to news broadcasts and reports concerning the out of court settlement in the case: Wiwa V.Shell Oil Company. According to the British Broadcasting Corporation (BBC), “Royal Dutch Shell has agreed to pay $15.5m to settle a lawsuit which accused the oil firm of complicity in rights abuses in Nigeria.” We have analyzed the settlement claim, made consultations and hereby state our positions as follows: 

 1. We commend the Wiwa’s family and others for utilizing the Alien Tort Claims Act in the United States to seek justice for Ken Saro Wiwa and others murdered by the Nigerian government and Shell Oil in 1995. We also, commend all supporters of the Ogoni cause for their respective roles – individually and collectively in this matter.

2. It is not over yet because the case between Ogoni people, Shell Oil Company and Federal Government of Nigeria is not about money. It is about justice. We want an end to economic strangulation, political marginalization and environmental racism in Ogoniland; and fragrant human right violations of Ogoni people.

3. Shell Oil maintained, “The payment was part of a “process of reconciliation.” We are reminding the world that 99.9% of Ogoni people still unequivocally maintain that Shell Oil remains persona non grata in Ogoniland. Shell Oil has refused to accept any guilt and we wonder why they agreed to settlement if they were not guilty. Ogonis are not ready to reconcile with Shell Oil and any covert or overt attempt by the company to step into Ogoni for Oil extraction would be totally resisted.

4 . We advise Shell Oil and the Nigerian government to stay clear of the Bomu, Bodo West, Tai, Korokoro, Yorla, Luubara Creek, and Afam Oil fields until the terms of the Ogoni Bill of Rights (OBR) addressed (including the creation of Ogoni State).

5. We also want to alert the world that Shell Oil has not stopped scheming to return to Ogoni land by all means possible. The company continues to twist the hands of the Nigerian government and some Ogoni politicians.  We are now surrounded by Police barracks (One of which was recently located in Kira, Sakpenwa), and a plan to establish an army of occupation and a military cantonment – the 2nd Amphibious brigade (Bori Camp), in Sogho Community in Ogoni. All these are in a bid to facilitate shell oil’s forceful re-entry into Ogoniland.

6. Shall the world sit, see Shell Oil Company forced down the throat of the Ogoni people because of the 250,000 barrels/ day of Oil and 10 trillion metric tons of natural gas in Ogoniland?  Ogoni shall not be extinct by Shell Oil.

7. Shell oil should also be reminded that every Ogoni son or daughter (within and without) has a stake in Ogoni; and no amount of “gesture” would appease them but by addressing the Ogoni Bill of Rights. It is also time they own up to the death of over 4000 Ogonis killed in 1993-96.

8. We regret the out of court settlement chiefly because Shell Oil’s dirty complicity in the “capture and hanging” of Ken Saro Wiwa and his kinsmen was prevented from been made public.

It is not over yet and we appeal to people of good will around the world to join us in seeking justice for Ogoni and its people by supporting the Ogoni Class Action Lawsuit because Shell Oil must have a day in court.
